Terms of Service

Welcome to Pixel Perfect ("we", "our", or "us"), operated by Function Labs. By accessing or using the Pixel Perfect app or website (the "Service"), you agree to be bound by these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you are at least 13 years old and agree to these Terms. If you are using the Service on behalf of an organization, you agree to these Terms on behalf of that organization.

2. Description of Service

Pixel Perfect is an AI-powered photo editing app that allows users to create professional headshots, profile pictures, cinematic portraits, avatars, and other creative image transformations. AI edits are generated based on user input and third-party AI services. Results may vary and are not guaranteed.

3. Monetisation Model: Free Welcome Credit and Paid Credits

Free Welcome Credit: New users receive one free credit upon registration. This welcome credit is granted once per account and cannot be claimed twice.

Paid Credits: Users can purchase consumable credit packs via Apple In-App Purchase (iOS) or Stripe (web). The UK packs are Starter Pack (15 credits for £4.99), Creator Pack (50 credits for £9.99), and Pro Pack (150 credits for £19.99). App Store pricing may vary by region and is confirmed before purchase. Paid credits are digital consumables used for AI edits. Paid credits do not expire, but they are depleted when used for AI edits.

• For iOS, purchases are processed through Apple's App Store using Apple In-App Purchase. Payment is charged to your Apple ID.
• Credits are consumed when you use AI generation tools. The credit cost of each action is displayed before you confirm it.
• If a generation fails due to a technical error on our side, the credit cost will be automatically refunded to your account.
• We do not offer subscriptions. There is no auto-renewal.
• The app does not show external checkout or website purchase links inside the iOS app for digital credits.

Refund Policy: Refunds for iOS purchases are handled through Apple. For purchases made directly on our website via Stripe, we offer refunds within 14 days of purchase for unused or defective services, subject to applicable consumer law. Credits redeemed or used are generally non-refundable, except for technical errors. To request a refund, please contact us at support@functionlabs.co.uk with your order details.

3a. AI Consent & Watermark

AI Processing Consent: Before each AI image edit, you must explicitly consent to your photo being sent to our AI processing provider (Replicate, Inc.) for processing. Consent requires active confirmation by clicking "I Agree" — it is never assumed, pre-ticked, or auto-accepted. You may decline at any time. Your data is not sold or used for advertising.

Watermark Policy: Your first welcome-credit generation produces a clean, watermark-free image. Subsequent generations include a small Pixel Perfect watermark. You can remove the watermark from any individual image by spending 1 credit. Watermark removal is applied per image and does not carry across future generations.

4. Acceptable Use

You agree to only upload images you have the rights or permission to use. You must not use the Service to:

• Upload or generate content that is illegal, abusive, exploitative, hateful, or violates any third-party rights.
• Create non-consensual intimate imagery or any content that sexualizes minors.
• Use the app to impersonate, harass, deceive, or defame others.
• Attempt to reverse-engineer, scrape, or abuse the platform's AI systems.
• Attempt to exploit bugs, bypass credit requirements, or generate prohibited content.
• Use the Service for any commercial spam, fraud, or deceptive advertising.

Function Labs may suspend accounts that abuse the service, attempt to exploit bugs, or generate prohibited content. We reserve the right to suspend or terminate accounts that violate these rules without refund.

5. Intellectual Property

You retain ownership of images you upload to the Service. By uploading content, you grant us a limited, non-exclusive licence to process your images solely to provide the requested Service features.

You own the AI-generated outputs created from your uploads, subject to compliance with these Terms. You may not claim that AI-generated images were created entirely by a human for deceptive purposes.

The Pixel Perfect brand, logo, software, and platform design are our exclusive property.

6. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or that AI-generated results will meet your expectations. AI generation quality may vary. The app may change features, limits, and pricing over time.

7. Limitation of Liability

To the fullest extent permitted by law, Function Labs and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, even if we have been advised of the possibility of such damages.

8. Termination

We reserve the right to suspend or terminate your account at our discretion if we believe you have violated these Terms. You may delete your account at any time. Upon termination, your credits and data will be permanently removed where legally and technically possible.

8a. Account & Data Deletion

You can delete your account and all associated data at any time directly within the app:

1. Open the app and go to Profile → User Settings → App Settings & Legal.
2. Tap "Delete Account" under the Account section.
3. Confirm the deletion in the prompt that appears.

Upon deletion, your saved creations, uploaded source images, generated images, profile details, non-essential analytics identifiers, and credit ledger will be permanently removed or pseudonymised where legally and technically possible, within 30 days. Deletion means database records are permanently removed. Pseudonymisation means financial transaction records (IAP purchases, credit transactions, ad events) have all personal identifiers replaced with a random, unlinkable reference — accounting fields are retained for tax and legal compliance, but the records can no longer be linked to you. Underlying cloud storage files are placed into an administrative cleanup queue and permanently deleted once confirmed by the storage provider. This action cannot be undone. 9. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. We will notify users of material changes where reasonably practicable.

10. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through binding arbitration or in a court of competent jurisdiction.
